Regularization of Services of Telangana Contract Employees GO 38 Dated 30.4.2023 Released

Telangana Governemt has released the Regularization orders for 5544 Contract Employees working in various departments in Telangana wide GO 38 Dated 30.4.2023.

మొత్తం 40 విభాగాల్లో, 5544 మంది కాంట్రాక్టు ఉద్యోగులను క్రమబద్దీకరణ చేస్తూ ఉత్తర్వులు విడుదల చేసిన తెలంగాణ ప్రభుత్వం.
కొత్త సచివాలయ ప్రారంభోత్సవ వేళ కాంట్రాక్టు ఉద్యోగుల్లో సంతోషం నిండింది. ఎన్నో రోజుల నుంచి ఎదురు చూస్తున్న కాంట్రాక్టు ఉద్యోగులకు ఈ ప్రతిష్టాత్మకమైన రోజున గుడ్ న్యూస్ వినిపించింది తెలంగాణ ప్రభుత్వం. పలు శాఖల్లోని 5544 పోస్టులను రెగ్యులరైజ్ చేస్తూ ప్రభుత్వం ఉత్తర్వులు జారీ చేసింది. అయితే.. కొత్త సచివాలయాన్ని ప్రారంభించి తన ఛాంబర్‌లో బాధ్యతలు స్వీకరించిన తర్వాత.. తొలి సంతకాన్ని కాంట్రాక్టు ఉద్యోగుల రెగ్యులరైజేషన్ ఫైల్ మీదే పెట్టటం విశేషం.

Order: 

Government after careful examination of the proposals received from the concerned administrative departments. hereby accord permission to the appointing authorities to appoint the following contract personnel on regular basis against the sanctioned posts, in terms of the orders issued in the reference read above. with effect from the date of issue of appointment orders.

The above administrative departments and HoDs shall take necessary further action for issue of individual name wise orders and appointment orders in terms of the proposals submitted by them. They shall also ensure that the appointments are made against sanctioned clear vacancies, no senior eligible person in overlooked or omitted and due verification of the relevant documents / certificates is made.

3.0rders of the Hon,. High Court in W.P. (PIL) No. 122 of 2017, dt.07-12-2021.

In the reference 1st cited orders were issued adapting the Andhra Pradesh Public Employment (Regulation of Appointments to Public Services and Rationalisation of Staff Pattern and Pay Structure, Act  (Act 2 of 1994 with certain modifications/ amendments for the purpose of facilitating its application in relation to thc State of Tclangana, and to regularize the services of persons appointed on contract basis, subject to fulfilment of certain conditions stipulated there in.

Subsequently,  circular instructions wcre also issued vide reference 2nd cited, to all the Departments of the Secretariat to forward proposals in thc prescribed checklist for regularization of services of eligible persons who fulfill the certain conditions, to the Finance (HRM) Department for scrutiny and concurrence before obtaining orders in circulation per Business Rules.

However, as per the interim orders of thc lionble High Court dated 26.04.2017 in the W.P.(PIL).No.122 of 2017, the process of the regularisation was partially interrupted. The Honble High Court in its final orders dated 07.12.2021 has dismissed W P.(PIL).No.122 of 2017, and related mutters.

In view of the above, all the Departments of the Secretariat arc requested to forward proposals fur regularization of services of eligible persons who fulfil the conditions mentioned in thc rekrenecs 1st & 2nd cited, to the Finance (HRM.I) Department for scrutiny and concurrence before obtaining orders in circulation, without a, further delay.

రాష్ట్రంలోని కాంట్రాక్టు ఉద్యోగులకు తెలంగాణ ప్రభుత్వం గుడ్ న్యూస్ చెప్పింది. కాంట్రాక్ట్ ఉద్యోగుల రెగ్యుల‌రైజేష‌న్ ప్రక్రియ‌కు సంబంధించి కీలక నిర్ణయం తీసుకుంది. కాంట్రాక్ట్ ఉద్యోగుల రెగ్యులరైజేషన్‌కు రాష్ట్ర ఆర్థిక శాఖ అనుమతులు ఇచ్చింది. 2016లో జారీ చేసిన జీవో 16 ప్రకారం అర్హులైన కాంట్రాక్ట్ ఉద్యోగుల వివరాలు పంపాలని ఆయా శాఖలను ఆర్థిక శాఖ కోరింది. ఈ మేరకు ఆర్థిక మంత్రిత్వ శాఖ ఉత్తర్వులు జారీ చేసింది.

మంజూరైన పోస్టుల్లో రోస్టర్, రూల్ ఆఫ్ రిజర్వేషన్‌కు అనుగుణంగా ఉన్న కాంట్రాక్ట్ ఉద్యోగులను క్రమబద్ధీకరించనున్నట్లు తెలిపిన ఆర్థిక శాఖ.. వీలైనంత త్వరగా ప్రతిపాదనలు పంపాలని కోరింది. కాగా, రాష్ట్రంలో కాంట్రాక్ట్ ఉద్యోగులందరినీ అర్హతల ఆధారంగా రెగ్యులరైజ్ చేస్తామని ముఖ్యమంత్రి కేసీఆర్ శాసనసభ సాక్షిగా ప్రకటించిన విషయం తెలిసిందే. ఈ ప్రకటన మేరకు రాష్ట్రంలో ఉన్న 11,103 కాంట్రాక్ట్ ఉద్యోగుల రెగ్యులరైజేషన్‌కు సంబంధించి కీలక ప్రకటన జారీ చేశారు. ఇక రాష్ట్ర ప్రభుత్వంలోని వివిధ శాఖల్లో ఖాళీగా ఉన్న పోస్టుల భర్తీకి నియామక ప్రక్రియను కూడా ప్రారంభించింది ప్రభుత్వం.

Acts- The Andhra Pradesh Re organisation Act, 2014 – The Andhra Pradesh Public Employment (Regulation of Appointments to Public Services and Rationalisation of Staff Pattern and Pay Structure) Act, 1994 (Act 2 of 1994) – Adaptation to the State of Telangana -Notification – Orders – Issued.

Order:
1. Whereas, by section 101 of the Andhra Pradesh Re organisation Act, 2014, the State of Telangana is empowered, by order, to make such adaptations and modifications of any law made before 02.06.2014, whether by way of repeal or amendment as may be necessary or expedient, for the purpose of facilitating the application of such law in the State of Telangana, before expiration of two years from 02.06.2014, and there upon every such law shall have effect subject to the adaptations and modifications so made until altered, repealed or amended by a competent Legislature or other competent authority;

2. And whereas it has become necessary to adapt the Andhra Pradesh Public Employment (Regulation of Appointments to Public Services and Rationalisation of Staff Pattern and Pay Structure) Act, 1994 (Act 2 of 1994) which was in force in the State of Andhra Pradesh as on 01.6.2014, with certain modifications / amendments for the purpose of facilitating its application in relation to the State of Telangana.

3. Accordingly, the following Notification will be published in an issue of the Telangana State Gazette.

  Regularization may be considered only in respect of eligible personnel working as on 2nd June, 2014, immediately before formation of Telangana State, and continuing till the date of proposed regularization.

4. For the purpose of continuity the annual breaks in certain vacation departments like Education and Welfare Departments may be ignored. This condonation shall not, however, apply in respect of breaks on account of unauthorized absence and disciplinary cases.

5. The regularization shall be with prospective effect, i.e., from the date of issue of orders of regularization and appointment to the category.

6. The backlog in reservations if any arising out of regularization as above shall be carried forward and treated as backlog vacancies for that particular category”.
